Mold/Mouse problem.. enough to break lease? slumlord heartless harpy. help?

I opened a tiny crawl space/closet thing today in our new home and noticed a LOT of dirty almost greenish insulation hanging from the ceilings and around the walls. the dust (altho I didn't see any, just smelt it) made my chest tighten and made me lose my breath for about 5 minutes. I've been sneezing a lot in and out of the home and was wondering if this could be mold? what would cause insulation to turn a limeish green (in some places deep green). we will be getting an at-home mold tester soon just to be sure.

Also, our landlord lied to us about having a mouse problem. after WE sealed up a ton of holes downstairs and complained to her, she still hasn't dealt with the problem. She said (and I quote) "I'll come around with a can of expanding foam to seal the holes around the house… but I dont want to hire our pest guy because he uses poison, and I don't like that" and we haven't seen or heard from her since.

We want OUT of this house, but can't afford to lose our deposit. We've tried talking to her about it, even offered to sublease or find her next tenant before we leave. But she won't budge. If the at-home test confirms mold.. are we free? Thanks.

these are very unsanitary conditions to live in. I really hope that you do not have any children in these conditions.

It really does seem like this would be enough to break the lease, BUT get plenty of evidence of these conditions (pics and video) as she will most likely try to take you to small claims court to retrieve the remaining balance of the lease.

I believe these problems are not enough to break the lease alone. If the landlord continues to do nothing about these problems, then you have grounds to break the lease. Keep a record of everything you do concerning this matter. Keep dates and times of everytime you complain about anything. Keep a record of what is being done and not done, when it was done and if nothing is done. go back and write down everything concerning the matter with the date and time as best you can remember. the Landlord has an obligation to provide a safe place for you. Look into contacting the local housing authorities if all else fails. But consider this a last resort, because you want to stay on the good side of your landlord. I am sure allowing mold to grow is breaking a housing ordinance of some type.
If the landlord does nothing for these problems in a timely manner then the landlord has already broken the lease. If you can prove that she has done nothing in regards to these problems you can sue her for your deposit and probably win. Be sure to take pictures of the mold to prove your case.
Mold is going to grow where it is dark and there is a lot of moisture. Your landlord may have a leaking roof or a plumbing problem. If your apt is under someone else it may be a plumbing/drainage problem.

For the mouse problem there are mouse traps available that do not use poison. they basically catch the mice without poison and then you can get rid of the mouse as you see fit. However, this an obligation of the landlord. this is not your responsibility. Your only responsibility is to keep your apt reasonably clean and report any

I agree, if this place has mold and mice (m&m's, but not the tasty kind! LOL) it is unsanitary and a health hazard to live in. I hope this landlord realizes that mice droppings can cause a fatal virus in humans. If you try to sweep up the droppings, and you breathe in the dust, you can get very ill and the survival rate is pretty low, because there is NO cure for this virus these buggers carry. Mold is another issue, that will make you ill, and cause chronic illness for you. If these two things can be proven and are present, move out, and most likely sue her in small claims for your deposit back. She knows of the problems, and shouldn't even rent that place out until she has them under control.

By the way, a quick way to get rid of a mouse problem is have cats! LOL we had a very cold winter a few years back, and I had some old dog food that my dogs wouldn't eat in the garage. the little critters found it, as well as some critter corn in the garage and the found a way into the house! I had 4 cats at the time, and those little creatures didn't have a chance! best non poisonous pest control out there!
